Usher Law Group, P.C.

Usher Law Group has practiced in Brooklyn since 2013. It is a litigation firm, and this site is its debt and credit practice: claims against debt collectors, debt buyers, collection law firms, credit bureaus and the companies that report to them, and the defense of collection lawsuits, in New York, New Jersey and Florida.

Mikhail Usher founded the firm in 2013 and runs it. When someone comes to us about a debt, the first questions are about the company: who is calling or writing, whether it is a collection agency, a debt buyer, a law firm or the original lender, and what it said and when. The next questions are about the paper: what the letters say, what the credit reports show, what was disputed and what came back, and whether a lawsuit has been filed. The answers decide which law applies. The FDCPA covers third-party collectors, debt buyers and collection lawyers, and usually not a lender collecting its own debt. The FCRA covers the credit bureaus and the companies that report to them. The TCPA covers robocalls to a cell phone. State law adds its own rules on top.

This site exists because the law in this area is written for lawyers, and the people who need it are usually reading it on a phone between collection calls. We maintain a documented ledger of every legal fact on this site with its source and the date we verified it. The violation checker and the call log apply only rules that appear in that ledger, and we update the pages and the tools when the primary sources change rather than on a publishing schedule.

What we do here

Claims against the company, and a defense when it sues

The practice

Collectors, debt buyers, collection law firms, credit bureaus and furnishers

We look at the calls, the letters and the credit reports, protect the deadline, bring the federal and state claims together, and take the case through discovery to settlement or trial. When a collector has sued you, we defend the lawsuit and look at your own claims against the collector at the same time.

Each kind of violation is described on the violations page, each kind of credit report error on the credit reports page, and each case starts with the free case review.

Three states

New York, New Jersey and Florida

Our attorneys are admitted in the state and federal courts of New York and New Jersey, and Mikhail Usher is admitted in Florida, where cases are handled through our Aventura office. The state rules differ, and the deadlines page goes through them one by one.

For a matter in another court we associate with local counsel or refer the matter, and we say which at the first conversation.

How we work

How we work on a debt or credit case

An attorney does the analysis

Paralegals and staff support the work, but the decisions about whether the company is covered, which calls and letters count, and which claims to bring are attorney work.

We protect the deadline first

An FDCPA claim has one year from the violation, and each call or letter has its own date. If you have been sued, the answer to the lawsuit comes before anything else.

We look at the lawsuit and the claims together

When a collector sues you, the same letters and calls often matter to your defense and to your own claims. We read them once, for both.

We get the record before it disappears

Voicemails, screenshots of your call history, the letters and their envelopes, your credit reports and your dispute letters, saved and organized in the first weeks.

We tell you the weaknesses

Including when the company is not covered by the law you hoped would apply, when a business debt falls outside the FDCPA, and when the honest advice is that the claim is not worth what it will cost you to bring it.

We publish no results figures

The public verdicts and settlements on this site describe other people's cases. We do not advertise our own results, and we will not predict yours.

We put the fee in writing

How our fee works is confirmed in a written retainer before we begin. The FDCPA requires a company found liable to pay the consumer's reasonable attorney's fees and costs. The TCPA has no fee-shifting clause, and the retainer says how that is handled.

We say no

If the case belongs with a different firm, or if there is no claim the facts will support, we tell you rather than taking a retainer.

Free case review

Tell us what they did.

One conversation with an attorney, in your language. We tell you which laws the collector or the credit bureau broke, which deadline runs first, and what to save this week. If it is not a case we can take, we say so and tell you where to go.
